These general conditions of sale relate to the purchase of products, made on the portal www.divinocosmetics.com owned by Divino Cosmetics Srl.
The products on www.divinocosmetics.com are sold directly by Divino Cosmetics Srl, Via Brondi n.16/D, int.10, 31055 Quinto di Treviso (TV), Italy.
Purchases on www.divinocosmetics.com are reserved for end customers, but also for merchants, wholesalers and resellers. The purchase operations are governed by the provisions of Legislative Decree no.185 / 99 (implementation of Directive 97/7 / EC relating to the protection of consumers in respect of distance contracts).
Acceptance by the customer
By sending the confirmation of their purchase order, the Customer unconditionally accepts and undertakes to observe, in relations with Divino Cosmetics Srl, the general and payment conditions reported in this section, declares to have read and accepted all the directions provided to him. Divino Cosmetics Srl is not considered bound to different conditions unless previously agreed in writing.
Purchase methods and terms
Purchases of products on www.divinocosmetics.com are made directly by the end customer at the price indicated on the site and which appears in the “cart” when using the “buy” icon, in addition to this price there may be other costs related to costs of shipping and taxes and / or customs duties where required by current legislation. Upon submitting the order confirmation, the user will still see a summary of the costs and any expenses, if any. Before confirming the purchase, the customer will be summarized the unit cost of each selected product, the total cost in case of purchase of multiple products and the related transport costs if any. Confirming the purchase, upon completion of the transaction, the customer will receive an e-mail message containing the date, its references, the unit amount of each individual product and the total amount of their order.
The payment of the products purchased on www.divinocosmetics.com can be made by the customer when forwarding the order confirmation by using one of the three types provided by our commercial area, namely:

In case of payment made by credit card, the financial information (for example: credit card number, expiry date) will not pass through our portal but will be transferred directly to the PAYPAL payment platform.

Shipping and delivery of products
The purchased products will be delivered by www.divinocosmetics.com to the address indicated by the customer. Product deliveries can take place during all working days. In the event that at the time of the order all the products regularly ordered and paid for by the customer are not in stock, the company Divino Cosmetics Srl will be able to split its shipment, without this entailing any liability for Divino Cosmetics Srl.

Orders and shipments form an integral and substantial part of these General Conditions of Sale and, therefore, are considered fully known and accepted at the time of transmission of the order form.
Warranties and defective products
The sale of products on www.divinocosmetics.com, owned by Divino Cosmetics Srl, is subject to discipline, as far as applicable, as per Legislative Decree 2.2.2002 n. 24 (G.U.n.57, 8.3.2002) on sales contracts and on guarantees relating to consumer goods and the specific provisions provided for in the Civil Code. The guarantees provided by the aforementioned legislation will apply to the product that has conformity defects and / or malfunctions not found at the time of purchase, provided that the product itself is used correctly and with due diligence. Any defect in the products must be reported within 14 (fourteen) days of receipt of the goods. The written report must be attached to the package, by the customer, upon return of the defective product to Divino Cosmetics Srl, Via Brondi n.16/D, int.10
31055 Quinto di Treviso (TV), Italy, reserves the right to verify the actual defect complained of by the customer and to replace only after this check. The request made by the customer will be processed only if the following documents are present in the package sent to us: order number and date, purchase invoice, brief description of the defect found. Obviously the costs of returning the goods to the sender remain the responsibility of the customer. For greater speed in handling the paperwork, before sending the defective goods, the customer must send an email to [email protected], describing the nature and / or type of failure. You will then receive the information necessary to avail of the guarantee. If this procedure is not applied, the time for repair and / or replacement of product could delay considerably.
Right for return
Pursuant to art. 5 DL 185/1999, if the customer is a final consumer, or a natural person who purchases the goods for non-commercial purposes, he has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty, made except, however, as indicated below. In order to exercise this right, the customer must send to Divino Cosmetics Srl, a communication within 14 working days from the date of receipt of the goods.
The communication must be sent by registered letter with return receipt, addressed to: Divino Cosmetics Srl, Via Brondi n.16/D, int.10, 31055 Quinto di Treviso (TV), Italy.
Legislative Decree 206/2005 – the deadline for repayment is 14 calendar days. The seller is required to reimburse all payments received by the consumer – including any shipping costs for the goods incurred during the purchase.
Once the aforementioned communication has been received, our Customer Service will immediately communicate to the customer the instructions on how to return the goods which must be carried out within 48 hours from the date of the aforementioned communication. The shipping costs for returning the goods remain the responsibility of the seller.
The customer’s right of withdrawal applies to the product purchased in its entirety; the purchased good must be intact and returned in its original packaging, not used and complete in all its parts; in the event of damage to the goods during transport, Divino Cosmetics will notify the customer of the incident (within 5 days of receiving the goods), to allow them to promptly file a complaint against the courier and obtain a refund of the value of the goods ( if insured); in this case, the product will be made available to the customer for its return.

Applicable law and competent court
This contract is governed by Italian law for distance contracts and in particular by the legislation relating to electronic commerce. For any dispute concerning the validity, interpretation or execution of the same contract, the territorial jurisdiction is of the judge of the place of residence or domicile of the consumer, if located in the territory of the State.
